Minutes of Hearing and Summary of Evidence, May 3, 2023, page 2, lines 6-9. The matter proceeded to trial on whether the applicant was entitled to TTD, after being terminated while working modified duties. Id. at page 2, lines 20-23. The parties stipulated that the applicant was working modified duties at the time of his termination on January 10, 2023. Id. at page 2, lines 17- 18. The applicant testified on his own behalf, in court, and Ms.

  Determinative passage · p.1Defendant has filed a petition for removal from the order vacating submission, striking medical reports, and order to develop the record ("Orders") issued on May 31, 2024, by the workers' compensation administrative law judge (WCJ). The WCJ vacated submission of this matter, ordered the reporting of the current qualified medical evaluator (QME) stricken because it did not constitute substantial medical evidence, and ordered development of the record with the parties either agreeing upon an agreed medical evaluator or a replacement QME, but absent an agreement, the WCJ would appoint a regular physician pursuant to Labor Code section 5701.

  The Appeals Board found that the WCJ erred in striking the QME reports as not substantial medical evidence and that removal was warranted due to potential prejudice and delay; however, the reports remain in the record but are not substantial evidence, and a replacement QME was properly ordered.
