What the panel ordered
Petition for Reconsideration denied.
Petition for Reconsideration filed and denied by the Workers' Compensation Appeals Board panel after review of the WCJ Report and record.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
Applicant did not meet her burden of proof to show that Defendant's MPN was invalid or that she was denied reasonable medical treatment outside the MPN.
From the decision · page 6A decision issued 6/26/2024 finding that Applicant had not met her burden of proof regarding applicant being allowed to treat outside Defendant's MPN.
The facts that decided it
What the panel treated as outcome-determinative, and which side it favoured.
Defendant's MPN was approved by the Administrative Director, creating a conclusive presumption of validity.
Favours Defendant prevailed
This presumption supports the denial of Applicant's claim to treat outside the MPN.
From the decision · page 6Labor Code Section 4616(b) (1) provides in pertinent part, "Upon a showing that the medical provider network was approved or deemed approved by the administrative director, there shall be a conclusive presumption on the part of the appeals board that the medical provider network was validly formed."
Applicant did not present evidence or witnesses at trial to rebut the presumption of the MPN's validity or to prove denial of care.
Favours Defendant prevailed
Lack of evidence led to the conclusion that Applicant did not meet her burden of proof.
From the decision · page 7As earlier noted, no witnesses testified at trial. Instead, applicant is raising arguments that were not presented at trial, and therefore waived. Applicant in the Petition refers to a series of claims that were not proved. For example, no statements were offered from the physicians who allegedly wouldn't treat 2020 injuries or work-related injuries or required a referral before treating a patient.

About this page
- A published decision of the California Workers' Compensation Appeals Board, taken apart by what it turned on. The Board publishes the decision itself; this page adds the extraction and quotes the passage behind every claim.
- The injured worker is not named here, and the case caption is not printed. Physicians appear as the decision names them, because a medical opinion is an act in a public proceeding.
- Issues, outcomes and weights were extracted by AI and released only where the source passage checked. Read the official decision before relying on anything here. Not legal advice.
