What the panel ordered
Petition for reconsideration denied.
Applicant sought reconsideration of the WCJ's Findings of Fact, Orders and Opinion on Decision issued September 11, 2021, which denied permanent disability for psychiatric injury.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
Applicant's injury was not found to be catastrophic under the statutory definition and relevant case law, so he is not entitled to an increased permanent disability rating for his psychiatric injury.
From the decision · page 7Applicant's injury is not the type of injury for which the Legislature sought to allow an increased impairment rating for a psychiatric condition. Therefore, we agree with the WCJ's conclusion that applicant did not sustain a catastrophic injury and may not receive an increased impairment rating for his psyche.
